1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Evtoan Technologies ("Company", "we", "us", "our") governing your access to and use of our website at evtoan.com, our digital product marketplace, our subscription services, and any software development or consultancy services we provide.

By creating an account, purchasing a product, subscribing to a plan, engaging our services, or simply browsing our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using our platform on behalf of a company or organisation, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Description of Services

Evtoan Technologies operates two primary offerings:

Digital Marketplace

A curated platform where users can purchase and download premium digital products including HTML templates, PHP scripts, mobile UI kits, WordPress themes, Figma design files, eBooks, and other digital assets. Products may be purchased individually or accessed through a subscription plan.

Software Agency Services

Custom software development, mobile app development, UI/UX design, graphic design, IT consultancy, and related professional services delivered pursuant to a separate project agreement or service order.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice where possible.

3. User Accounts

To access most features of our platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept responsibility for all activity under your account
• Notify us immediately at info@evtoan.com of any unauthorised use of your account
• Not share your account credentials with third parties
• Not create more than one account per person without explicit written permission

You must be at least 18 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Marketplace & Digital Products

Product Availability

All digital products are sold "as described." We make reasonable efforts to ensure product descriptions are accurate and up-to-date. Product previews, screenshots, and demos are for illustration purposes.

Instant Delivery

Upon successful payment, digital products are made available for immediate download through your account dashboard. Downloads are available for the lifetime of your account.

Product Updates

Where a product author releases updates, these may be made available to existing purchasers at our discretion. We do not guarantee continued updates to any purchased product.

File Integrity

We scan all products for malicious code before publication. However, you are responsible for testing any product in a safe environment before deploying it to production.

5. Licenses & Intellectual Property

Standard License

When you purchase a digital product under the Standard License, you receive a non-exclusive, non-transferable right to use the product in a single end product — whether for personal or commercial use — where the end product is not sold or redistributed. The Standard License does not permit:

• Using the item in more than one project (additional purchases are required)
• Reselling, redistributing, or sublicensing the item or its source files
• Claiming authorship or ownership of the item

Extended License

The Extended License grants the same rights as the Standard License, plus the right to use the item in a product that is sold to end users. Extended License holders may use the product in unlimited projects.

Subscription Downloads

Products downloaded during an active subscription period are licensed under the Standard License for the duration of your subscription and beyond — you retain the right to use downloaded products even after your subscription ends.

Our Intellectual Property

The Evtoan Technologies brand, logo, website design, platform code, and all content we produce (other than user-submitted products) remain our exclusive property. You may not reproduce, distribute, or create derivative works from our platform materials without written permission.

6. Agency & Custom Development Services

Custom development projects are governed by a separate Service Agreement or Statement of Work signed between you and Evtoan Technologies. In the absence of such an agreement, the following defaults apply:

• A 50% deposit is required before work commences
• The remaining 50% is due upon project completion before final file handover
• All deliverables and intellectual property transfer to the client upon receipt of final payment
• We provide six (6) months of free bug-fix support following project delivery
• New feature requests beyond the agreed scope are quoted separately
• We are not liable for delays caused by client-side dependencies or information gaps

Project timelines are estimates. We make every effort to deliver on schedule but do not guarantee specific completion dates unless contractually committed in writing.

7. Subscriptions

Subscription plans grant access to our full product library with a defined monthly download allowance. Key terms:

• Subscriptions renew automatically at the end of each billing period unless cancelled
• You may cancel your subscription at any time; access continues until the end of the paid period
• Download allowances reset monthly and do not roll over
• Sharing a subscription account with other users is strictly prohibited
• We reserve the right to change subscription pricing with 30 days' notice to existing subscribers

8. Payments & Pricing

All prices are displayed in USD unless otherwise stated. Payments are processed securely through Paystack and Flutterwave. We do not store your card details on our servers.

You are responsible for any taxes, duties, or levies applicable to your purchase under the laws of your jurisdiction. Prices shown on our platform are exclusive of any such taxes unless expressly stated.

In the event of a payment dispute or chargeback, we reserve the right to suspend your account pending resolution.

9. Refunds

Please refer to our full Refund Policy for complete details. In summary:

• Digital product purchases are generally non-refundable once downloaded
• Subscriptions carry a 7-day satisfaction guarantee from the date of first payment
• Refund requests must be submitted to info@evtoan.com within the applicable window
• Agency project deposits are non-refundable once work has commenced

10. Prohibited Conduct

You agree not to:

• Use our platform for any unlawful purpose or in violation of any applicable laws
• Resell, redistribute, or share downloaded digital products in violation of the applicable license
• Attempt to reverse-engineer, decompile, or extract source code from our platform
• Upload or distribute malicious code, viruses, or harmful software through our platform
• Engage in fraudulent transactions or misrepresent your identity
• Scrape, crawl, or systematically extract data from our website without written permission
• Circumvent or attempt to circumvent any access controls, security measures, or subscription limits
• Harass, threaten, or abuse other users or our staff

Violation of these rules may result in immediate account termination and, where applicable, legal action.

11. Disclaimers & Limitation of Liability

Our platform and all content are provided "as is" and "as available" without warranty of any kind. We do not warrant that our services will be uninterrupted, error-free, or free of security vulnerabilities.

To the maximum extent permitted by applicable law, Evtoan Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our platform, including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the total amount paid by you to us in the three months preceding the claim.

12. Termination

We may suspend or terminate your account and access to our services at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to violation of these Terms, fraudulent activity, or prolonged inactivity.

You may close your account at any time by contacting us at info@evtoan.com. Upon termination, your license to use downloaded products under the Standard License shall survive for products you have already downloaded.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Rwanda. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Rwanda, without prejudice to any right to seek injunctive or other equitable relief in any jurisdiction.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or a prominent notice on our website at least 14 days before the changes take effect. Your continued use of our platform after changes become effective constitutes your acceptance of the revised Terms.
